These Terms and Conditions of Use (\u201cTerms and Conditions of Use\u201d or \u201cTCU\u201d) apply to browsing the website www.fondation-gattefosse.org (the \u201cWebsite\u201d) and to the use of the Website\u2019s features.<\/p>

By accessing the Website, the user (the \u201cUser\u201d) acknowledges that they have read and accepted without reservation all these Terms and Conditions of Use and undertakes to comply with them.<\/p>

These Terms and Conditions of Use may be revised by the Gattefoss\u00e9 Foundation at any time without any formalities other than the publication of a new, amended version online, the latter taking precedence over any previous version.<\/p>

2. Access to the Website<\/strong><\/p>

The Website is accessible free of charge from any location to any User with internet access.<\/p>

All costs necessary to access the Website (hardware, software, internet connection, etc.) are the responsibility of the User.<\/p>

In the event of maintenance work, events beyond the Gattefoss\u00e9 Foundation\u2019s control, technical failure or force majeure, access to the Website may be interrupted or suspended without notice or justification, and the Gattefoss\u00e9 Foundation shall not be held liable.<\/p>

Furthermore, the Gattefoss\u00e9 Foundation reserves the right to interrupt or permanently cease the operation of the Website at any time, without prior notice or justification, and without being held liable.<\/p>

3. Intellectual property<\/strong><\/p>

The trademarks, whether registered or not, logos and acronyms featured on the Website, as well as all its content (text, images, photographs, illustrations, layouts, etc.), are the exclusive property of the Gattefoss\u00e9 Foundation<\/p>

Any reproduction, representation, publication, redistribution or copying of all or part of these elements must be authorised in advance by the Gattefoss\u00e9 Foundation.<\/p>

Failure to comply with this obligation may constitute an act of infringement punishable under Articles L335-2 et seq. of the Intellectual Property Code.<\/p>

Access to the Website shall not be construed as conferring upon the User any licence or intellectual property right whatsoever in respect of the Website and\/or its content.<\/p>

Furthermore, no User may use any automated process to access, scrape or extract the data contained or presented on the Website.<\/p>

Without prejudice to the foregoing, any User may download the materials made available on the Site. These materials may only be used for personal and informational purposes, for the exception of any commercial and\/or advertising use. The Gattefoss\u00e9 Foundation makes no warranty, whether express or implied, regarding the Website and\/or all or part of its content.<\/p>

The Gattefoss\u00e9 Foundation will use its best endeavours to ensure that the information presented on the Website is accurate, up to date and reliable, but shall in no event be held liable for any error or omission in this regard.<\/p>

The information presented on the Website is provided for information purposes only.<\/p>

Consequently, the Gattefoss\u00e9 Foundation shall not be held liable for any damage, direct or indirect, of any nature whatsoever arising from the User\u2019s use of the information presented on the Website.<\/p>

7. Applicable law, competent courts<\/strong><\/p>

These General Terms and Conditions of Use are governed by French law. The User may, at their sole discretion, choose to contact the GATTEFOSSE Foundation and\/or subscribe to the GATTEFOSSE Foundation\u2019s Newsletter.<\/p>

To ensure a response and\/or receipt of the Newsletter<\/p>

Personal data is any information that may enable, directly or indirectly, the identification of a natural person.<\/p>

This personal data protection policy applies to personal data collected by the Gattefoss\u00e9 Foundation directly from users (the \u201cUsers\u201d) of the website www.fondation-gattefosse.org (the \u201cWebsite\u201d).<\/p>

In its capacity as data controller, the Gattefoss\u00e9 Foundation undertakes to collect, process and store Users\u2019 personal data in complete confidentiality and in accordance with the provisions of this policy, the French Data Protection Act and the General Data Protection Regulation.<\/p>

By completing the contact form or the newsletter subscription form, the User acknowledges that they have read and accepted without reservation the terms of this personal data protection policy.<\/p>

The Gattefoss\u00e9 Foundation collects the personal data that Users consent to provide. The collection and processing of this data are for the following purposes:<\/p>

\u2013 Management and processing of requests for information, access, rectification, erasure or portability of personal data, or requests to object to or restrict the processing of data.<\/p>

Retention period: 2 years<\/p>

2. Newsletter subscription form:<\/span><\/strong><\/p>

Data collected: email address, surname, first name, country and profession.<\/p>

Purpose of processing:<\/p>

– distribution of an information resource, the \u201cNewsletter\u201d, to subscribers.<\/p>

Distribution of information regarding the Foundation\u2019s programmes,<\/p>

Retention period: 5 years.<\/p>

The User may choose to unsubscribe from this Newsletter at any time.<\/p>

Subscription to the Newsletter shall not exceed five years and will require the User to renew their consent.<\/p>

The personal data collected will be deleted:<\/p>

\u2013 Upon expiry of the various periods set out above; or<\/p>

\u2013 At the User\u2019s request, in accordance with applicable regulations and the terms set out below (subject to any legal retention obligations).<\/p>

3. Solidarity Program form:<\/strong><\/span><\/p>

Data collected: surname, first name, email address, job title, name of organisation, website, country.<\/p>

Purpose of processing:<\/p>

\u2013 Management and processing of applications submitted solely by candidates;<\/p>

\u2013 Management and processing of requests for information, access, rectification, erasure or portability of personal data, as well as requests to object to or restrict the processing of data.<\/p>

Retention period: 5 years.<\/p>

The personal data collected will be deleted:<\/p>

\u2013 Upon expiry of the various time limits set out above; or<\/p>

\u2013 At the User\u2019s request, in accordance with applicable regulations and the terms set out below (subject to any legal obligation to retain data).<\/p>

3. Disclosure<\/strong><\/p>

This data may not be disclosed to third parties for commercial and\/or promotional purposes without the User\u2019s prior consent.<\/p>

However, this data may be transferred to certain technical service providers\/subcontractors of the Gattefoss\u00e9 Foundation (hosting provider and marketing communications provider) who are bound by confidentiality and data security obligations, and exclusively for the purposes described in Article 2 above.<\/p>

The Gattefoss\u00e9 Foundation may be required to disclose the data to the competent administrative or judicial authorities, upon their request.<\/p>

4. Confidentiality and security<\/strong><\/p>

The Gattefoss\u00e9 Foundation undertakes to implement all necessary technical and organisational measures to preserve the confidentiality and security of the personal data collected on the Website.<\/p>

However, the Gattefoss\u00e9 Foundation shall not be held liable for any security breach attributable to the User.<\/p>

5. User Rights<\/strong><\/p>

In accordance with the provisions of Law No. 78-17 of 6 January 1978 on data processing, files and freedoms (known as the \u2018Data Protection Act\u2019) and European Regulation 2016\/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (known as the \u201cGDPR\u201d), the User has the following rights regarding their personal data:<\/p>

  • Right to erasure; to deletion;<\/li>

  • Right to restriction of processing.<\/li><\/ul>

    These rights may be exercised at any time by the User by sending an email to: dataprotection@gattefosse.com, if proof of identity is attached.<\/p>

    In the event of an unsatisfactory response from the Gattefoss\u00e9 Foundation regarding the exercise of the rights mentioned below, the User may lodge a complaint with the French Data Protection Authority (Commission Nationale de l\u2019Informatique et des Libert\u00e9s, \u2018CNIL\u2019).<\/p>
